The Court Has Ruled

What the Borgarting Court Actually Decided

The 2023 Norwegian appeal ruling that upheld a ban on English bulldog and cavalier King Charles spaniel breeding remains the most precisely reasoned judicial statement on conformation-linked suffering yet produced by any European court.

Read the judgment

Four countries now write dog breeding into statute, and no two use the same mechanism. One of them measures the muzzle.

The grade that travels with the dog

Nought to three, and the dog it belongs to

The Respiratory Function Grading Scheme, run by the Kennel Club with the University of Cambridge, produces a record of a different kind from a registration or a placing: a grade from 0 to III attached to one named animal.

What the assessment measures
  • 0Clinically unaffected on the exercise protocol
  • IClinically unaffected, mild audible noise
  • IIClinically affected — breeding advice attaches

Where the law differs

Breeding law stops at the border

The Netherlands has legislated a minimum muzzle length since 2019. Norway's appeal court ruled against bulldog and cavalier breeding in 2023. Germany's Tierschutzgesetz §11b prohibits Qualzucht outright, and England licenses breeders under the 2018 regulations. Four countries, four instruments, one continent.
